Will Wisconsin's Patents Block Embryonic Stem Cell Research? An article by Washburn in the Los Angeles Times and a separate article by Loring and Campbell in Science suggest that the presence of patents by a University of Wisconsin professor (Thomson) may be a greater impediment to embryonic stem cell research than the funding limitations imposed by George Bush in 2001. These suggestions do not contemplate the research safe harbor created by the Hatch-Waxman Act in 35 USC 271(e)(1) as interpreted by the Supreme Court in Merck v. Integra.
Los Angeles Times Article Way Off Base on Stem Cell IssuesAn article in the Los Angeles Times of April 12, 2006 entitled "The legal lock on stem cells; Two patents that cover key research areas are setting back science" is way off base as to patent issues in stem cell research. Criticizing two patents assigned to Wisconsin's WARF (US 5,843,780 and No. 6,200,806), the article suggests the "monopoly" threatens the future of stem cell research. The article ignores the research exemption created through the Hatch-Waxman Act as interpreted by the U.S. Supreme Court in Merck v. Integra. Furthermore, rather ironically, it ignores the reality that Wisconsin, in seeking royalties, is doing exactly what California seeks to do through Proposition 71, which is to obtain patent royalties.

Nicholas Gonzalez reviewed 10,000 patient records; He interviewed and evaluated 500 of Kelley’s patients who had all been diagnosed with advanced cancers and found in most cases the survival rate had increased dramatically.
