As patients, we put our trust into doctors, nurses and medical facilities. Unfortunately, there are many ways a patient can fall victim to further personal injury than when he initially entered the care of the medical professional even from the simplest of medical procedures.

As patients, we put our trust into doctors, nurses and medical facilities. We trust that these medical professionals will have the knowledge, expertise and composure to provide the proper care. Likewise, we trust that the medical facilities we enter are well-equipped to ensure our safety and allow medical professionals to properly do their jobs. 

 

Unfortunately, there are many ways a patient can fall victim to further personal injury than when he initially entered the care of the medical professional even from the simplest of medical procedures. When medical professionals provide negligent or substandard care for a patient or act improperly as a result of carelessness or ignorance, and the patient is injured as a result, medical malpractice has occurred.

 

Individual medical professionals can be held liable for medical malpractice as well as entire medical facilities including hospitals, clinics and nursing homes. Within hospitals, emergency rooms can be especially vulnerable to medical malpractice, particularly if the ERs are understaffed or ill-equipped. Emergency medical technicians (EMTs) and paramedics can make costly and even grave medical mistakes that lead to malpractice.  Nursing homes that do not provide adequate food, shelter, supervision, medical care, etc. can also be targets of medical malpractice lawsuits.

 

Types of malpractice

 

In its severest form, medical malpractice can lead to wrongful death. However, there are many other types of malpractice that can lead to a lifetime of medical complications, including:

 

·         Surgical: operating on the wrong body parts or organs

·         Birth injuries: cerebral palsy, Erb’s palsy, brain injury

·         Medication errors: wrong drugs given or prescribed due to illegible or misunderstood prescriptions

·         Anesthesia errors: incorrect dosages, improper patient monitoring, etc.

·         Patient monitoring disregard: infections, medication side effects, etc.

·         Medical equipment errors: faulty design, manufacturing defects, lack of training

·         Incorrect or delayed diagnosis or treatment: cancer, heart attack, etc.

 

Time is of the essence

 

Most states have a statute of limitations on when you can file a lawsuit for medical malpractice. For example, in Florida the malpractice claim time limit is two years from the date of the incident. It is important to contact an experienced malpractice attorney as soon as possible after your incident so you do not lose the opportunity to recover damages.

 

Medical malpractice lawsuits can help identify medical professionals who are under qualified, overworked, malicious or use poor judgment. By identifying substandard care provided by these professionals and/or the medical facilities, future incidents of malpractice may be avoided. There is no excuse for shoddy medical care, and injured patients have the rights to recover damages resulting from these inadequacies.
