Securities Fraud is Stealing

Brokers … well, some brokers don’t play by the rules and seem to “win” no matter what is happening to everyone else. Could it be securities fraud?
We hit a recession and the stock market goes down. We come out of the recession and the stock market goes up. Investors win; investors lose. Brokers … well, some brokers don’t play by the rules and seem to “win” no matter what is happening to everyone else. Could it be securities fraud?
What is Securities Fraud?
The encyclopedia defines securities fraud as “a practice in which investors make purchase or sale decisions on the basis of false information, frequently resulting in losses, in violation of the securities laws.”
The FBI also includes falsifying information on corporate financial statements, SEC filings, lying to corporate auditors, insider trading, stock manipulation schemes and embezzlement by stockbrokers as types of securities fraud.
Securities are considered to be stocks, bonds, commodities and other investments.
Who Commits Securities Fraud?
You might think it would be limited to stockbrokers, but investors also commit securities fraud. So do brokerage house employees, corporate executives and shareholders.
Can I Get My Investments Back?
If you’ve lost investments strictly due to the normal, and daily, fluctuation in the market, it is likely that your investments will grow again over time.
Losing your life savings to securities fraud also has hope. In order to prove that your broker engaged in an illegal practice, you would have to be able to show that he or she withheld important information, made trades in such a way that you incurred exorbitant fees or was involved in some other form of securities fraud.
How Do I Prove I Was a Victim Of Securities Fraud?
That’s where a skilled and experienced securities fraud lawyer comes in. As an investor, you aren’t expected to know or understand all the rules and regulations that brokers are to be held accountable for. You aren’t expected to know how to tell the difference between a solid stock tip and insider trading, although you should learn.
Bottom line – securities fraud is stealing. Attorneys that specialize in handling securities fraud cases can examine your specific situation and help you reclaim what was stolen from you. Those who commit securities fraud don’t mess around. Neither should you.
